Jokerz is a free game about basketball box scores. You earn Tokens by playing. Tokens have no cash value and cannot be bought, sold or cashed out. There are no cash prizes. You can buy Blue Tokens and Jokerz Pro in the app, but they never buy you a better score or a way into a game. Be real, be kind, and do not pretend to be someone else.
1. Who we are and what you agree to
These Terms of Use are an agreement between you and Sacred Blue Studios Inc., an Ontario, Canada company ("we", "us", "Jokerz"). They cover the Jokerz app, the website at playjokerz.com, the Jokerz Podcast, the ShoutBox and everything else we offer (together, the "Service"). By creating an account or using the Service you agree to these terms, to our Privacy Policy, our Acceptable Use Policy and our Purchases and refunds page. If you do not agree, do not use Jokerz.
2. Who can use Jokerz
You must be 13 or older to use Jokerz. We ask for your birth year when you sign up. If you are under 13 we close the account.
You must be 18 or older to buy anything or to use the ShoutBox. The app shows the shop only to accounts that are 18 or over, and our servers check again for the ShoutBox.
In Quebec the law treats 13 year olds differently; see the Privacy Policy, section 12.
You may not use Jokerz if you have been removed from it before, or if the law where you live does not allow it.
3. Your account
You sign in with Apple or Google. You are responsible for what happens under your account, so keep your Apple or Google account secure.
Give us true information, including your birth year, and keep it up to date. Keep one account only.
Your handle must not be someone else's name or pass you off as a player, a coach, a team, a company or Jokerz staff. We may reserve a name, change a handle or ask you to pick another when it does.
Do not sell, rent, trade or give away your account.
Jokerz is free to play. The games (Starting 5, Magic Hand, leagues and the others we add) turn real box scores into five card hands. You pick before a game tips, and the app scores your picks after the game from the stats we receive. The rules of each game are shown in the app and on the How it works page.
Scores depend on statistics from sports data sources. If a stat is wrong or changes later, we may correct hands, scores, rankings and Tokens, and our correction is final.
We may change how a game works, how cards are dealt or how scoring runs, and we may start, pause or end a game or a league at any time. A change applies from when we make it.
Jokerz is not a gambling product. It costs nothing to enter, nothing you can buy gives you a better chance, and there is nothing of cash value to win. It is not a lottery, a sweepstakes or a contest with a prize.
If your state or province does not allow free to play prediction games, do not use Jokerz there.
5. Tokens and Blue Tokens
There are two kinds.
Tokens (the gold ones) are earned by playing and by other things we reward. They are never for sale. They have no cash value, cannot be bought, sold, traded, given away or cashed out, and are not property. They can be spent only inside Jokerz. Any bonus Tokens for top places are flat amounts and also have no cash value. We may adjust, reset or remove Tokens to fix a bug, fix an error, enforce these terms or stop abuse.
Blue Tokens are bought only in the app, through the Apple App Store (and Google Play on Android). They pay for ShoutBox airtime. They never expire, never turn into Tokens, never buy a way into a game or a better score, never show on a leaderboard and have no cash value. You cannot sell or trade them or give them to anyone. You get a personal, limited right to use them in Jokerz while your account is open; you do not own them.
Jokerz Pro is an auto renewing subscription, also bought only in the app. It adds 100 Blue Tokens a day, removes ads on the website and gives early access to new modes.
Everything about paying, cancelling a subscription and refunds is on the Purchases and refunds page, which is part of these terms. The website sells nothing. If you delete your account, your unused Tokens and Blue Tokens are deleted with it.
6. Fan Levels and vouches
Fan Levels, badges and claims are self reported. A level is a fun way to recognize fans. It is not a certificate, a ranking by an official body or a statement by Jokerz that a claim is true.
A vouch is the opinion of the person who gave it. Jokerz does not check it. A badge that says "Checked by Jokerz" means a Jokerz staff member looked at the proof you gave, nothing more.
Make only claims that are true. Proof links must be lawful and must not point to anything private, adult or harmful. Do not vouch for something you do not know to be true. Do not make or trade vouches in a group to raise levels.
If you ask a friend to vouch by email, you may only email people you know, only about claims you really made, and you are responsible for it. We will not send the same address more than one email a day.
We may hide, reduce or remove a claim, a vouch, a badge or a level that looks false, abused or harmful.
7. Your content and the license you give us
"Your content" means what you put into Jokerz: your handle, photo, fan card text, claims and notes, proof links, vouches, league names, feedback, and shouts (your recordings, text, photos and any names, city and social handles you add). You keep ownership of it. Because Jokerz has to show it to others, you give us a worldwide, non exclusive, royalty free license to host, store, reproduce, edit for length and sound, display, publish and distribute your content as part of the Service and to promote the Service.
For a shout, this includes broadcasting it and publishing it in episodes, clips and posts on the Jokerz Podcast feed, YouTube, our website and our social accounts. This license for a shout that has aired continues after you delete your account, as the delete screen tells you; we take your name, city, photo and handles off our records of it. Email support@playjokerz.com if you want an aired shout taken down.
For everything else, the license ends when you delete the content or your account, except for copies we must keep by law and copies other people already made through the features of the Service.
You promise that:
you own your content or have the right to use it and to give us this license;
it does not break the law or anyone's rights, including copyright, privacy and publicity rights (no music, no recordings of other people without their permission);
We may review, refuse, hide or remove content, and suspend accounts, at any time. You can report content in the app and block people. If you think something on Jokerz infringes your copyright, email support@playjokerz.com with what the work is, where it is, your contact details and a statement that you are the owner or can act for the owner, and we will look at it.
8. The ShoutBox
The ShoutBox is for people 18 and over.
Every shout is screened and then approved by a person before it can air. Paying for airtime does not guarantee that a shout will air. A shout we do not air is refunded in the Blue Tokens or Tokens you paid with.
Shouts that air may be marked as paid on air, and the hosts may change, cut or answer a shout. The hosts' views are their own.
Do not send anything you would not say with the whole league listening: no slurs, threats, personal attacks, private information about others, or sales pitches.
9. Rules for using Jokerz
There is no tolerance for objectionable content or abusive users on Jokerz. We remove the content and close the accounts that break these rules.
You agree to follow the Acceptable Use Policy. In short: no cheating, bots or scraping; no harassment, hate, threats or sexual content; no impersonation, including pretending to be a player or a coach; no fake claims or fake vouches; no spam or abuse of invites; no buying, selling or trading accounts or Tokens; no attacks on our systems.
10. Players, coaches and likeness
Jokerz shows the names and public statistics of real players and teams and drawn artwork of some players. Jokerz is not connected to, endorsed by or licensed by the NBA, the NBPA, any league, team or player. Team names, logos and marks belong to their owners. If you are a player or coach, or the estate or agent of one, and want your picture replaced, want to ask how you appear, or want to claim your profile, write to support@playjokerz.com. We aim to switch a picture to the generic silhouette within 48 hours of a request. Jokerz never asks for a password, a sign in code, a photo of an ID or money by message and never contacts anyone first with a link; see how Jokerz contacts players and coaches.
11. What belongs to us
The Service, including the software, the card designs and artwork, the characters and hosts, the name and logo, the audio and the videos, belongs to Sacred Blue Studios Inc. or its licensors and is protected by law. We give you a personal, limited, revocable, non transferable license to use the Service for yourself and not for business. You may not copy, sell, reverse engineer or build a competing product from it, or use bots or scrapers on it. If you send us ideas or feedback, we may use them without paying you.
12. Apple, Google and other companies
These terms are between you and us. Apple and Google are not parties to them and are not responsible for Jokerz, for its content, for support or for any claim about it. If the app does not work as promised, Apple may refund the app price (if any); beyond that, Apple has no duty about the app. Apple and its subsidiaries are third party beneficiaries of these terms for the iOS app and may enforce them against you. The same applies to Google for the Android app.
You must also follow the terms of the store you use (the Apple Media Services Terms, or Google Play Terms of Service) and the terms of any third party service you use with Jokerz. The Apple standard license terms for apps apply to the iOS app to the extent they do not conflict with these terms.

Links to other websites and videos are outside our control.
13. Ending your use, and ours
You can stop any time, and delete your account in the app. We may warn you, hide content, take away Tokens or badges, or suspend or close your account if we think you broke these terms or the rules, if the law requires it, or if the Service ends. If we close your account for breaking the rules, we are not required to refund Tokens, and Blue Tokens are handled as the Purchases page says. Sections that by their nature should survive (our license to aired shouts, ownership, disclaimers, limits, law) do.
14. Disclaimers and limits
Jokerz is provided "as is" and "as available". We try hard, but we do not promise it will always work, be error free, have accurate statistics, or that the live scores, hands and rankings will be right. To the most the law allows, we are not responsible for indirect or consequential loss, lost data, lost Tokens, or loss from a problem with the stores, your device or your network, and our total responsibility to you for any claim about the Service is limited to the greater of what you paid us through the Service in the 12 months before the claim and CAD $100. Some places do not allow some of these limits; in those places the limits apply as far as the law lets them. Nothing here limits any right you have under consumer law that cannot be limited.
15. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If we cannot sort out a disagreement by talking (please write to us first), the courts of Ontario, sitting in Toronto, can decide it, except that you may bring a claim in your local small claims court or in the courts of the place you live if the law of that place says you may. Mandatory consumer rights where you live are not affected.
16. Changes
We may change these terms. The date at the top says when they last changed. If a change matters, we will tell you in the app or by email before it starts. If you use Jokerz after the change starts, you accept it; if you do not, stop and delete your account.
